The following selection of questions are often asked by our clients.

I applied but forgot to tell you about a creditor?

If you fail to disclose all creditors this can jeopardise both legal and informal agreements that we make with your creditors. As such you must tell us immediately if you have another creditor to add to the ones we already know about.

My I.V.A. is rejected by creditors?

This is an unlikely event, but if it does happen we will simply transfer your case to our informal debt solutions department and continue acting for you in all dealings with your creditors. An annual review will be performed and, if your circumstances change so that a legal solution becomes a possibility, we will advise you accordingly.

My creditors claim that you haven't contacted them?

Some creditors may say that they have not heard from us in order to put pressure on you to make a payment to them. This is not necessary, simply get a contact name and telephone number from the creditor and we will contact them to confirm when and how we have contacted them. When we contact a creditor we always have docuementary evidence of having done so.

My creditors say they haven't received payment from you?

Your creditors will automatically receive payment from us each and every month if you are an informal debt solution client and if we received your monthly disposable income on the date agreed. A statement detailing the payments made to each of your creditors will be sent to you; should a creditor tell you they have not received payment please refer them to this statement - or if in any doubt please contact us.

My creditors repeatedly phone me chasing payments?

Explain to them that we are acting on your behalf and in due course will be making arrangements for payment. Obtain the contact details from the creditor and pass them on to us; we will then contact the company concerned and update them on the status of your case.

I get a letter from a solicitor or agency chasing an outstanding debt?

If the letter is from someone who has had the debt passed on to them to deal with then you must inform us and send the letter to us immediately. If we already have the contact details for the solicitor or debt collecting agent then you need not send us the letter.

A creditor threatens to send a bailiff to my house?

Some creditors will mention bailiffs to try and scare you into making a payment. If you are unsure what to do, please contact us. Usually however bailiffs can only become involved if you have stopped making payments after a County Court Judgement has been issued.

I have an existing CCJ registered against me?

You must continue to make payments as agreed with the court. These will be allowed for in your agreement if you include them in your regular expenditures. If you are a legal debt solution client entering into an I.V.A. only once that arrangement is in place will you stop making payments. You will be informed when this happens.
